Waiver & Release SOCA-2026-v1.1

1 · What This Is

This is an informal community run and walk, not a sanctioned, permitted, timed, or officiated race. There is no entry fee, no timing, no chips, no bibs, no closed course, and no traffic control. Nobody is directing vehicles. There is no medical staff on the route. Volunteers may point the way, but they are neither traffic officers nor medical professionals, and no one is supervising the route.

I am joining a group of community members going for a run or walk on public sidewalks and park trails, crossing streets only at normal marked crosswalks and only on the signal, exactly as any pedestrian would. I am responsible for my own safety. I will obey all traffic signals and laws exactly as I would on any other day, I will cross streets only when it is safe to do so, and I will not rely on anyone else to stop traffic or protect me.

2 · Assumption of Risk

I understand that participating carries risks including, but not limited to: falls; contact with other participants, pedestrians, vehicles, or animals; the effects of weather including heat, humidity, cold, rain, and sun; traffic and road and trail conditions; uneven or slippery surfaces; heart attack, heat exhaustion, dehydration, and other medical conditions; and the transmission of communicable disease. I am voluntarily participating with knowledge of these risks and I assume all of them, both known and unknown, including those that may arise from the negligence of others.

3 · Release of Liability

In consideration of being included, I, for myself and for my heirs, executors, administrators, and anyone else who might claim on my behalf, hereby release, waive, and discharge from any and all claims, demands, damages, actions, and causes of action arising out of or related to any loss, damage, injury, illness, or death I may suffer while participating:

  • The Elite Collective, LLC and Elevate Well™
  • Caribbean SEAFEST Seattle and the Center for Linguistic and Cultural Democracy
  • All sponsors, partners, and their representatives
  • All officers, directors, employees, contractors, volunteers, and agents of each of the above

This release applies to claims arising from ordinary negligence. It does not apply to gross negligence, reckless conduct, or intentional misconduct, and it does not waive any right that cannot be waived under Washington law. If any part of this release is found unenforceable, the remainder stays in effect.

4 · Medical Acknowledgment

I confirm that I am physically able to participate, or that I have chosen to participate knowing my own condition, and that I have not been advised against participation by a medical professional. I authorize emergency personnel to provide or arrange emergency medical treatment for me if I am unable to consent at the time, and I accept financial responsibility for that treatment. No medical insurance is provided. In an emergency, call 911.

5 · Participants Under 18

A participant under the age of 18 on August 9 may only join with the consent of a parent or legal guardian. If you are registering for someone under 18, you confirm that you are their parent or legal guardian, that you have read this document in full, that you consent to their participation, that you agree to every term above on their behalf and on your own, and that you will be responsible for their supervision during the event.

6 · Agreement

I have read this document in full. I understand it is a release of liability and a contract. I sign it freely and voluntarily, and I intend it to be a complete and unconditional release of all liability to the greatest extent allowed by Washington law. This agreement is governed by the laws of the State of Washington.
